SERVICES OFFERED
PRC Services Corporation provides computer hardware, software, technical support, and consulting services (the “Services”) to Customers. The Services are subject to the terms and conditions of this Agreement.
PRICING AND PAYMENT
The prices of the Services are listed on the PRC Services Corporation’s website or quoted by a sales person and are subject to change without notice. Payment for the Services must be made at the time of purchase by credit card or other accepted payment method. All prices are exclusive of any applicable taxes or fees, which shall be paid by the Customer.
DELIVERY
Delivery of the Services will be made within a reasonable time after the Customer has paid for the Services. PRC Services Corporation will make every effort to deliver the Services on time but is not responsible for any delays due to circumstances beyond its control.
REFUNDS AND CANCELLATIONS
Refunds and cancellations will be handled on a case-by-case basis, subject to the following conditions: (i) all requests for refunds or cancellations must be made in writing to PRC Services Corporation within 30 days of purchase; (ii) refunds will only be issued for Services that have not been delivered or rendered; (iii) cancellations made after Services have been delivered or rendered will not be eligible for refunds.
LIMITATION OF LIABILITY
PRC Services Corporation shall not be liable for any damages of any kind arising from the use of the Services, including but not limited to direct, indirect, incidental, punitive, and consequential damages. PRC Services Corporation does not warrant that the Services will be uninterrupted or error-free.
INTELLECTUAL PROPERTY
The Customer acknowledges that all intellectual property rights, including but not limited to copyrights, trademarks, and patents, in the Services are the property of PRC Services Corporation or its licensors. The Customer may not reproduce, modify, or distribute any part of the Services without the express written consent of PRC Services Corporation.
PRIVACY POLICY
PRC Services Corporation collects and uses Customer data and information in accordance with its Privacy Policy, which is available on PRC Services Corporation’s website.
GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico without regard to its conflict of law provisions. The Parties agree that any disputes arising out of or in connection with this Agreement shall be resolved in the courts of the Commonwealth of Puerto Rico.
TERMINATION
Either Party may terminate this Agreement at any time for any reason upon written notice to the other Party.
AMENDMENTS
PRC Services Corporation may amend this Agreement at any time by posting the amended terms on its website. The amended terms will become effective 30 days after they are posted on the website. If the Customer objects to any amendments, the Customer may terminate this Agreement by giving written notice to PRC Services Corporation.
